Terms of Service

Welcome to RingTide. These Terms of Service ("Terms") govern your access to and use of the RingTide AI phone agent dashboard service ("Service") provided by RingTide ("we", "our", or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms
By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Service Description
RingTide provides a dashboard platform for managing and analyzing AI-powered phone agents. Our Service includes:
- •Call history viewing and management
- •Call transcripts and recordings access
- •AI-generated call summaries and sentiment analysis
- •Analytics and reporting dashboards
- •Agent configuration and management
- •Team collaboration and multi-tenant organization support
3. Accounts & Registration
Account Creation
To use our Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
Account Security
You must use a strong password (minimum 12 characters with uppercase, lowercase, numbers, and special characters) and notify us immediately of any unauthorized access or security breach. We recommend enabling multi-factor authentication when available.
Age Requirement
You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.
4. Acceptable Use
You agree not to use our Service to:
- ✕Violate any applicable laws, regulations, or third-party rights
- ✕Make calls for illegal purposes, harassment, or fraud
- ✕Attempt to gain unauthorized access to our systems or other users' accounts
- ✕Interfere with or disrupt the Service or servers
- ✕Reverse engineer, decompile, or disassemble any part of the Service
- ✕Use automated systems to access the Service without permission
- ✕Transmit malware, viruses, or other harmful code
5. Data Ownership
Your Data: You retain all ownership rights to your data, including call recordings, transcripts, and any other content you upload or generate through the Service. We do not claim ownership of your data.
License Grant: By using our Service, you grant us a limited license to process, store, and display your data solely to provide and improve the Service. This license terminates when you delete your data or close your account.
Data Export: You may export your data at any time through the Service's export functionality or by contacting support.
6. Intellectual Property
The Service, including its design, features, code, documentation, and content (excluding your data), is owned by RingTide and protected by intellectual property laws. "RingTide" and our logo are trademarks of RingTide. You may not use our trademarks without prior written permission. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted to use the Service.
7. Payment Terms
Subscription Fees
Certain features of the Service may require payment. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law or as otherwise stated in these Terms.
Price Changes
We may change our prices with 30 days' notice. Price changes will take effect at the start of your next billing period after the notice.
Taxes
All fees are exclusive of applicable taxes (including GST/HST), which will be added to your invoice as required by law.
8. Disclaimer of Warranties
Important Notice
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RINGTIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS ($100 CAD), WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless RingTide and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your data or content.
11. Termination
By You
You may terminate your account at any time by contacting us or using the account deletion feature in Settings. Upon termination, you will lose access to the Service and your data will be handled according to our Privacy Policy.
By Us
We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or if we reasonably believe such action is necessary to protect the Service, our users, or third parties.
Effect of Termination
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Effective" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
